What Is Settlement Day Like for Canterbury Buyers

Settlement day is when the keys to your new Canterbury property are finally handed over. Here is exactly what happens, when you can expect to move in, and what can still go wrong.

Settlement day is the day ownership of your Canterbury property legally transfers to you. It is both a legal and financial event managed primarily by your solicitor, and a practical milestone after which you can take possession of your new home.

The Pre-Settlement Inspection

In the 24-48 hours before settlement, you have the right to a pre-settlement inspection. Use it. Walk through the property and confirm: it is in the same condition as when you made your offer (no damage, no deterioration); all listed chattels are present and in working order; the property is vacant and clean if vacant possession was agreed; and there are no unexpected changes. If you discover issues - a heat pump that has stopped working, damage that occurred after the agreement was signed, chattels that have been removed - notify your solicitor immediately. These issues can be resolved by holding funds in trust, negotiating a price adjustment, or delaying settlement pending repair.

What Happens on the Day Itself

Settlement happens at the time specified in your agreement - commonly 2pm, 3pm, or 4pm. You do not need to be at your solicitor's office. Your solicitor draws down your mortgage from your bank and receives any cash contribution from your own funds. They transfer the full settlement amount to the vendor's solicitor. The vendor's solicitor pays out the vendor's mortgage, commission, and fees, and transfers the net balance to the vendor. The title is then transferred into your name through the LINZ electronic system. Once your solicitor confirms all funds have been received by the vendor's side, keys are released - typically to the real estate agent who then makes them available to you.

When You Can Move In

You can take possession once settlement is confirmed and keys are released. This is typically in the afternoon of settlement day. For Friday settlements (common in Canterbury), this can sometimes be late afternoon, so plan your moving logistics with this in mind. If you have removalists booked, brief them that access may not be possible before 3-4pm on settlement day.

If Settlement Is Delayed

If the vendor cannot settle on time, you are entitled to late settlement interest and compensation for reasonable costs. If you cannot settle on time, you must pay the vendor late settlement interest. Either way, contact your solicitor immediately if anything threatens to delay settlement - they manage the legal remedies.
